Privacy Policy

White & Ward Ltd is responsible for the operation of https://shop.stuart.com (“the Shop”). We are also responsible for the control of all data involved with a user onboarding to, interacting with and ordering from the Shop, and delivering ordered Products. White & Ward Ltd understands that your privacy is important to you and that you care about how your personal data is used and shared online. We respect and value the privacy of everyone who visits the Shop and will only collect and use personal data in ways that are described here, and in a manner that is consistent with our obligations and your rights under the law. 

Please read this Policy carefully and ensure that you understand it. Your acceptance of our Privacy & Cookie Policy is deemed to occur upon your first use of the Shop. If you do not accept and agree with this Privacy Policy, you must stop using the Shop immediately.

1. Your Rights

As a data subject, you have the following rights under the GDPR, which this Policy and Our use of personal data have been designed to uphold:

  • The right to be informed about Our collection and use of personal data;
  • The right of access to the personal data We hold about you;
  • The right to rectification if any personal data We hold about you is inaccurate or incomplete;
  • The right to be forgotten – i.e. the right to ask Us to delete any personal data We hold about you;
  • The right to restrict (i.e. prevent) the processing of your personal data;
  • The right to data portability (obtaining a copy of your personal data to re-use with another service or organisation);
  • The right to object to Us using your personal data for particular purposes; and
  • Rights with respect to automated decision making and profiling;
  • The right to complain to an external supervisory authority (The Member State of habitual residence;

2. Data Collection

Depending upon your use of the Shop, We may collect some or all of the following personal data:

  • name;
  • date of birth;
  • gender;
  • contact information such as email addresses and telephone numbers;
  • demographic information such as post code, preferences and interests;
  • financial information such as credit / debit card numbers;
  • IP address;
  • web browser type and version;
  • operating system;
  • a list of URLs starting with a referring site, your activity on the Shop, and the site you exit to;

3. Data Usage

All personal data is processed and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected. We will comply with Our obligations and safeguard your rights under the GDPR at all times.

Our use of your personal data will always have a lawful basis. Specifically, We may use your data for the following purposes:

  • Providing and managing your Account;
  • Providing and managing your access to the Shop;
  • Personalising and tailoring your experience on the Shop;
  • Supplying Stuart products to you (please note that We require your personal data in order to enter into a contract with you);
  • Personalising and tailoring Stuart products for you;
  • Replying to emails from you;
  • Market research;
  • Analysing your use of the Shop to enable Us to continually improve the Shop and your user experience;
  • Delivering your ordered Products.

 

We automatically process data pertaining to location, including residence and or delivery addresses, but use no other automated processes, and do not ‘profile’ you.

With your permission and/or where permitted by law, We may also use your data for contact purposes which may include contacting you by email, telephone, text message or post with information and news. We will not, however, send you any unsolicited marketing or spam and will take all reasonable steps to ensure that We fully protect your rights and comply with Our obligations under the GDPR and the Privacy and Electronic Communications (EC Directive) Regulations 2003.

4. Data Storage

We only keep your personal data for as long as We need to in order to use it as described above, and/or for as long as We have your permission to keep it.

Some or all of your data may be stored outside of the European Economic Area (“the EEA”) (The EEA consists of all EU member states, plus Norway, Iceland, and Liechtenstein). You are deemed to accept and agree to this by using the Shop and submitting information to Us. If We do store data outside the EEA, We will take all reasonable steps to ensure that your data is treated as safely and securely regardless of whether the data is stored within the UK or Europe and under the GDPR.

Data security is very important to Us, and to protect your data We have taken suitable measures to safeguard and secure data collected through the Shop.

We will store all personal information and data provided by you on our secure (password and firewall protected) servers. All electronic transactions you make to or receive from us will be handled by Stripe. This website is secured by SSL technology to ensure all data is safe.

5. Data Control

You have the following control concerning your personal information:

 

  • Access: You can request access to the personal information we hold about you.
  • Rectification: You can request that we correct any inaccuracies in your personal information.
  • Erasure: You can request the deletion of your personal information, subject to legal and regulatory requirements.
  • Withdrawal of Consent: You can withdraw your consent for data processing at any time.

 

Opt-Out: You can opt by choosing not to access the Shop or purchase equipment through the Shop.

A Cookie is a small text file placed on your computer or device by the Shop when you visit certain parts of the Shop and/or when you use certain features of the Shop. Details of the Cookies used by the Shop are set out in section 8.

The Shop uses Cookies and similar technologies in order to distinguish you from other users. By using Cookies, We are able to provide you with a better experience and to improve Our Site by better understanding how you use it.

7. Changes to policy

We may change this Privacy & Cookie Policy, (for example, if the law changes). Any changes will be immediately posted on the Shop and you will be deemed to have accepted the terms of the Privacy Policy on your first use of the Shop following the alterations. We recommend that you check this page regularly to keep up-to-date.

8. GDPR ART.13

1. Where personal data relating to a data subject are collected from the data subject, the controller shall, at the time when personal data are obtained, provide the data subject with all of the following information:

  1. a) the identity and the contact details of the controller and, where applicable, of the controller’s representative; See Intro

    b) the contact details of the data protection officer, where applicable; See Intro

    c) the purposes of the processing for which the personal data are intended as well as the legal basis for the processing; See Data Usage

    d) where the processing is based on point (f) of Article 6(1), the legitimate interests pursued by the controller or by a third party. See Data Usage

    e) the recipients or categories of recipients of the personal data, if any;

    f) where applicable, the fact that the controller intends to transfer personal data to a third country or international organisation and the existence or absence of an adequacy decision by the Commission, or in the case of transfers referred to in Article 46 or 47, or the second subparagraph of Article 49(1), reference to the appropriate or suitable safeguards and the means by which to obtain a copy of them or where they have been made available. 2. In addition to the information referred to in paragraph 1, the controller shall, at the time when personal data are obtained, provide the data subject with the following further information necessary to ensure fair and transparent processing:

a) the period for which the personal data will be stored, or if that is not possible, the criteria used to determine that period; See Data Storage

b) the existence of the right to request from the controller access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability.

c) where the processing is based on point (a) of Article 6(1) or point (a) of Article 9(2), the existence of the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal;

3. Where the controller intends to further process the personal data for a purpose other than that for which the personal data were collected, the controller shall provide the data subject prior to that further processing with information on that other purpose and with any relevant further information as referred to in paragraph 2. We state all usages

4. Paragraphs 1, 2 and 3 shall not apply where and insofar as the data subject already has the information.
